However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

On August 16, 2012, the Defendant was sentenced to a two-year suspended sentence of imprisonment with prison labor for 8 months at the Gwangju District Court for fraud, and the said judgment was finalized on August 24, 2012, and on January 4, 2013, the Defendant was sentenced to a two-year suspended sentence of imprisonment with prison labor for 6 months at the Gwangju District Court for fraud and was sentenced to a two-year suspended sentence on January 12, 2013;

In collusion with B on June 22, 2010, the facts at the Seo-gu Hyundai Motor Agent in Gwangju, Seo-gu, Gwangju, agreed to pay back the vehicle to another place in order to raise the business funds of the victim Hyundai Capital Co., Ltd., even if the vehicle was purchased with installment loans from the victim Hyundai Capital Co., Ltd., and at the time, B did not have the intent or ability to pay the installment normally, and therefore, B did not have the intent or ability to pay the installment normally. In the event that B purchased Grand Co., Ltd. through its business members D and applied for the loan of KRW 19.2 million to the victim Hyundai Capital Co., Ltd. in the name of business members B, while applying for the loan of KRW 22.1 million, it appears that the loan rate of KRW 8.24% per annum per annum and KRW 608,324 won per month ("270,209 won") for the loan period of KRW 36 months and that it would have been obtained from the victim company.

The fact is that the Defendant did not have the intent or ability to carry on the online game-related business with the victim as the price for selling the vehicle from the victim E even if it was sold. On October 2010, 2010, the Defendant: (a) purchased a vehicle in the name of the party; (b) made a false statement to the victim E that “after purchasing the vehicle in the name of the party; (c) prepared it; and (d) made the same online game-related business at the same time as the online game-related business,” and (c) caused the victim to purchase the vehicle in the amount of 32960,000,000 won of the market price at 48 months at the Seo-gu Seoul, Seo-gu, Gwangju, to obtain the vehicle immediately from the victim.
