1. On May 22, 2014, each of the real estate listed in the separate sheet between the Defendant and the New East SPS Support Co., Ltd.
1. Basic facts
A. On September 15, 2011, the Plaintiff entered into a credit guarantee agreement with the New East SS Support Co., Ltd. (former trade name before the change: hereinafter “New SS Support”), and issued a credit guarantee agreement to the New SS Support. On the same day, the Plaintiff was loaned from a national bank.
B. On August 19, 2014, New East U.S. Support lost a benefit due to overdue interest, etc., and the Plaintiff subrogated to the National Bank for KRW 70,906,221 of the principal and interest of new U.S. Support on October 13, 2014.
Then, on March 10, 2015, the Plaintiff filed a lawsuit against Shin Dong-dong Overseas Support (Seoul Central District Court Decision 2014Da5312782 Decided March 10, 2015) to claim the payment of the amount of compensation (Seoul Central District Court Decision 2014Da5312782 Decided 10, the judgment below became final and conclusive at that time, stating that the Plaintiff shall pay to the Plaintiff 71,048,751 won and 70,906,221 won per annum from October 13, 2014 to November 19, 2014; and that the interest rate of 20% per annum from the next day to the date of full payment.
C. When the Defendant leased equipment at the construction site of Shindong-dong SPS support, but failed to receive rent, on May 22, 2014, the Defendant entered into a pre-sale agreement (hereinafter “instant pre-sale agreement”) with respect to each of the real estate listed in the separate sheet (hereinafter “instant real estate”) on May 22, 2014 to secure the rent, and completed the provisional registration of ownership transfer claim in the name of each of the Defendant (hereinafter “instant provisional registration of ownership transfer claim”) under the title No. 56650 on May 23, 2014 and the title No. 2 real estate listed in the separate sheet (hereinafter “instant two real estate”) under the title No. 56651 on May 23, 2014 as to each of the instant real estate (hereinafter “instant provisional registration of ownership transfer claim”).
