The prosecution of this case is dismissed.
On December 22, 2012, at around 23:47, the Defendant publicly insulting the foregoing E by saying, “Irk-gu, the police officer E (33 years of age) affiliated with the Gwangju Northern Police Station D District D District of the Gwangju Northern Police Station, who was dispatched after receiving a report of the assault case, “Irk-gu, who wanted to handle the report by accompanying only the parties,” was sexually insultingly insulting to the horses, while three police officers dispatched, F, G, and three police officers called “Irk-gu, Irk-gu,” and “Irk-gu,” respectively.
Judgment
However, the facts charged of this case are crimes falling under Article 311 of the Criminal Act, which can be prosecuted only when a victim files a complaint pursuant to Article 312(1) of the Criminal Act. Since it is recognized that the victim expressed his/her intent to “dissipate the complaint against the defendant” around March 16, 2013 after the prosecution of this case was instituted, the prosecution of this case is dismissed pursuant to Article 327(5) of the Criminal Procedure Act.
