The prosecution of this case is dismissed.
Reasons
1. 공소사실 피고인은 2016. 9. 5. 22:00 경 대전 서구 C 아파트 상가에 있는 피고인 운영의 상가에서, 평소 감정이 좋지 않았던 피해자 D( 남, 57세) 과 시비가 되어 E 등 2~3 명이 듣고 있는 가운데 피해자에게 “ 야 개새끼야, 씨 발 놈 아, 병신새끼, 니가 빽이 있어 개새끼야 ”라고 큰소리로 말하였다.
Accordingly, the defendant openly insultingd the victim.

(a) An offense subject to prosecution on complaint (Article 312 (1) of the Criminal Act);
B. Revocation of complaint by the victim after the prosecution of this case
