1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
1. Details of the disposition;
A. After being appointed as a public official belonging to Seoul Special Metropolitan City on May 13, 198, the Plaintiff served as the team leader of the B place of business management and the traffic restriction vehicle control team from January 15, 2014 to July 23, 2017. From July 24, 2017, the Plaintiff served as the urban traffic headquarters C.
B. On February 9, 2018, the Defendant issued a disciplinary action of salary reduction for three months (hereinafter “instant disposition”) against the Plaintiff pursuant to Article 69(1) of the Local Public Officials Act, on the ground that the Plaintiff’s act as follows violates Articles 48 and 55 (Duty of Fidelity) of the Local Public Officials Act, Article 13 (Prohibition of Private Use and Profit-making of Public Goods) of the Code of Conduct for Public Officials, Article 11 of the former Code of Conduct for Public Officials (wholly amended by Seoul Metropolitan Government Regulation No. 4229, Aug. 2, 2018).
On October 2, 2016, the Plaintiff neglected emergency duty by neglecting his/her subordinate employee who works at night due to the issuance of a space space bulletin, despite the fact that he/she is an emergency standby worker due to the issuance of the first disciplinary reason (e.g., neglect of air duty).
The Second Disciplinary Reason [Act of Private Use and Profit-making of Public Goods] The Plaintiff used a public vehicle on several occasions, such as using a public vehicle to return home at his/her home (2015 A, B, B) or his/her own home (2016 and September 23, 2016) to a funeral hall, and thereby interfered with the duties of the vehicles under control.
On October 20, 2016, the Plaintiff stated that the head of the D division “I must open” while ascertaining the causes of the dispute between the employees that occurred in the second alcohol-for-all event of the Regulation Team for Restriction on Operation-of-Business Operation Vehicle(s) with the head of the D division who is the head of the affiliated department.
The 4th Disciplinary Reason [Voluntary Change and Organization of Control Working Group] The Plaintiff voluntarily changed and organized the control work group during leave by the director of D, the head of the department.
C. The Plaintiff is dissatisfied with the instant disposition and on March 5, 2018.
