1. The Defendant shall pay to the Plaintiff KRW 30,00,000 and the interest rate of KRW 15% per annum from September 23, 2015 to the day of complete payment.
According to the purport of the entire argument in Gap evidence No. 4, the plaintiff lent KRW 30,000,000 to C on March 11, 2013 as of October 11, 2013, and at the time the defendant guaranteed C's above loan obligation.
According to the above facts of recognition, barring any special circumstance, the defendant, as a guarantor, is obligated to pay to the plaintiff 30,000,000 won and damages for delay calculated at the rate of 15% per annum from September 23, 2015 to the day of complete payment, as requested by the plaintiff, from September 23, 2015, which is the day following the day when a duplicate of the complaint of this case is served to the defendant.
In regard to this, the defendant is merely the guarantor, and it is alleged that the above loan was used by the Faart Construction Co., Ltd., and thus the plaintiff cannot respond to the plaintiff's claim. However, the defendant's above assertion is not reasonable.
Therefore, the plaintiff's claim is justified and it is so decided as per Disposition.
