1. The Defendant’s KRW 100,000,000 as well as the Plaintiff’s annual interest from January 1, 2020 to June 8, 2020, and the following.
The Plaintiff lent KRW 80,00,000 to the Defendant on May 9, 2019 as of August 31, 2019. The Plaintiff loaned KRW 20,000 to the Defendant on July 9, 2019 as of December 31, 2019, respectively, with the due date set as of December 31, 2019, may be recognized pursuant to the respective entries in the evidence Nos. 1 and 2 and the purport of the entire pleadings.
According to the above facts, the defendant is obligated to pay to the plaintiff 1,00,000 won and damages for delay calculated at the rate of 5% per annum prescribed in the Civil Act from January 1, 2020 to June 8, 2020, the delivery date of a copy of the complaint of this case from January 1, 2020, and 12% per annum prescribed in the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the next day to the day of full payment.
Therefore, the plaintiff's claim of this case is justified and it is so decided as per Disposition.
