On August 1, 2019, the Defendant: (a) received a proposal from an employee of Bosinging on his name, “I would transfer money to a personal account; (b) would pay KRW 180,000 per day to the account giving instructions after withdrawing money; and (c) notified the account number (C) in the name of the Defendant with knowledge of the crime of Bosing fraud.

On the same day, the above-mentioned person was transferred KRW 5,60,000 to the above-mentioned B bank account in the name of the defendant for repayment of loans around 14:18 on the same day by making false statement to the purport that "I will make a loan to repay part of the existing loans at low interest rate," although there is no intention or ability to make a loan to the victim D by telephone at the same time on the same day."

At around 14:52 on the same day, the Defendant withdrawn KRW 5,600,000 deposited as above, and remitted it to the account without passbook designated by the winners of name deposits.

Accordingly, the defendant, by facilitating the fraud of a person who has not received a name, assisted it.

The defendant thought that he had no intention to commit the crime of this case since he thought that he had been a legitimate part of the day as stated in its holding, but the records revealed as follows. In other words, the defendant had been convicted of having been involved in the crime of Bophishing even around 2016, and has been subject to a disposition of suspension of indictment; ② the amount of KRW 180,000 per day presented by the defendant in return for the work as stated in its reasoning is remarkably higher than the degree of difficulty of the day; ③ the amount of money that the defendant was a false part of his name, ③ the defendant was not using the company account as a three-dimensional problem.
