1. The Defendants deliver to the Plaintiff each real estate listed in the separate sheet 1 to 22.
2. Defendant B shall be the Plaintiff.
1. Basic facts
A. Defendant D and Defendant C are married, and Defendant B is a father and wife of the above Defendants.
B. On December 27, 2012, the Plaintiff entered into a lease agreement with Defendant B as the lessee for each real estate listed in attached Tables 1 through 20 (hereinafter “instant real estate”) with the lease term of KRW 24 months from December 27, 2012, and the lease fee of KRW 40 million per annum.
(hereinafter referred to as “instant one lease contract”). Paragraph (2) of the Special Agreement on the Lease stipulated, “Defendant B shall pay the Plaintiff rent of KRW 40 million per annum in advance on the commencement date of the lease contract, and pay KRW 40 million per annum in the same month as the same month of the following year, and at the time of non-performance of the contract, 20% per annum in interest rate shall be added to the annual interest rate of KRW 20 million until the expiration date of the contract.”
From December 27, 2012, the Defendants engaged in penture business in the real estate of this case 1 to 20.
C. Around July 2014, the Plaintiff newly constructed each real estate listed in [Attachment 21 and 22 (hereinafter “instant real estate”) and entered into a lease agreement with Defendant D by setting a rent of KRW 10 million per annum with respect to the said real estate.
(hereinafter “instant two lease contract”). The Defendants, from July 30, 2014, carried out pension business in the said building. D.
On February 3, 2015, the Plaintiff concluded a real estate security trust agreement on the real estate of this case between Nonparty 1 and Nonparty 22, and completed the registration of ownership transfer based on the trust.
Article 10(1) and (2) of the Real Estate Security Trust Contract shall be deemed as valid when a lease contract has been concluded between a truster and a lessee before a trust contract is concluded, and the truster shall continue to maintain the status of a lessor, such as a duty to return the lease deposit, and other responsibilities and rights as a lessor.
