피고인은 2016. 2. 20. 01:30경 경기도 성남시 중원구 B에 있는 'C' 주점에서 일행인 D과 술을 마시다가 만취하여 술값을 지불하지 않는 등 소란을 피워 112신고를 받고 출동한 경기성남중원경찰서 E지구대 소속 경사인 피해자 F, 순경인 피해자 G으로부터 술값을 지불할 것을 요청받자, 위 주점의 종업원인 H 등이 듣고 있는 가운데 피해자 F에게 "개새끼들아, 경찰 새끼면 다냐."라고 큰소리로 말하고, 피해자 G에게 "야, 개새끼야, 너가 경찰 새끼냐, 씹할 놈아, 그러니까 짭새지."라고 큰소리로 말하여 공연히 피해자들을 모욕하였다.
