This is a crime that falls under Article 3 (1) of the Act on Special Cases concerning the Settlement of Traffic Accidents and Article 268 of the Criminal Code, and it is not possible to institute a public prosecution against the victim's express intent under Article 3 (2) of the Act on Special Cases concerning the Settlement of Traffic

According to the written agreement submitted to this court, the victim can recognize the fact that he/she expressed his/her wish not to punish the defendant after instituting the public prosecution of this case. Thus, the public prosecution of this case is dismissed pursuant to Article 327 subparagraph 6 of the Criminal Procedure Act.
