임대차보증금반환
1. The Defendant’s KRW 370,000,000 as well as the annual rate of KRW 5% from September 21, 2019 to February 1, 2020, and the following day.
1. On December 2, 2016, the Plaintiff, based on the claim, concluded a lease contract with the lease deposit amounting to KRW 370,000,000, and the lease term from February 6, 2017 to May 6, 2019, and completed the resident registration on the same day after obtaining the delivery of the instant apartment on February 7, 2017.
C sold the apartment of this case to the Defendant, and completed the registration of ownership transfer under the Sung-nam Branch Branch of Suwon District Court No. 65651 on September 27, 2018, and the Defendant succeeded to the lessor status.
On April 12, 2019, the Plaintiff sent the notification of the termination of the lease agreement to the Defendant by content-certified mail, and completed delivery of the instant building on September 20, 2019.
Therefore, the Plaintiff seeks payment from September 21, 2019 to the date of delivery of the application for modification of the claim and the cause of the claim of this case from September 21, 2019 to the date of delivery of the application for modification of the claim of this case, and 12% per annum from the following day to the date of full payment.
2. Judgment by service (Article 208 (3) 3 of the Civil Procedure Act).
