[2016고단16] C은 2015. 6. 10. 06:40경 의정부시 D에 있는 ‘E’ 식당에서 일행인 피고인이 피해자 F(25세)으로부터 멱살을 잡히고 주먹으로 왼쪽 어깨를 맞고, 바닥에 넘어지는 등 폭행을 당하고 피해자가 C의 여자 친구에게 욕설을 하는 것을 보자, 피해자 멱살을 잡고 테이블에 있던 소주병으로 피해자 머리를 2회 내리치고 피해자가 넘어지자 주먹으로 피해자의 얼굴을 수회 때리고 발로 걷어찼으며, 피고인은 이에 가세하여 피해자를 걷어차는 등 폭행하여, C과 공동하여 피해자에게 약 21일간의 치료가 필요한 두피의 열린 상처, 아래다리 부위의 후근육군의 기타 근육 및 힘줄의 손상 등의 상해를 가하였다.
