피고인은 2014. 8. 16. 02:00 경 원주시 D에 있는 ‘E’ 2 층에서, 피해자가 잠을 자려고 누워 있는 모습을 보고 피해자의 옆에 누워 “ 예쁘니까 그러는 거야 ”라고 말하면서 갑자기 피해자의 왼쪽 허리를 쓰다듬다 배 쪽으로 손을 올려 옷 위로 가슴을 더듬고, 이에 피해자가 팔짱을 끼면서 만지지 못하게 하자 손으로 피해자의 팔을 강제로 푼 후, 옷 안으로 손을 집어넣어 피해자의 젖꼭지를 손으로 비틀고, 바지 위로 피해자의 음부 부위를 만져 추행하였다.
