A. The Plaintiff was appointed as a local public official on May 2, 1990, and was promoted to Grade 6 on January 16, 2007, and served in Grade 5 on July 1, 2010, and thereafter, the Plaintiff was deliberated and decided on the subject of administrative Grade 5 promotion at the personnel committee for Ansan-si on December 31, 2012. On January 2, 2013, the Plaintiff was selected as “persons subject to class 5 promotion” and completed the promotion period from January 28, 2013 to March 8, 2013, and the Plaintiff was excluded from Grade 30, upon notification from Grade 5 personnel management teams on March 8, 2013.

On the other hand, C and D, which completed the 5-class promotionist course, were promoted to Grade V officials on March 9, 2013.

B. The investigation and trial 1) of the Plaintiff filed a petition with the office of the Suwon District Prosecutors' Office to the effect that he/she offered a bribe to six public officials in Ansan-si including the Plaintiff. On March 6, 2013, the office of Eunpyeong Housing Site Administration requested cooperation in investigation to send six personnel data including the Plaintiff to the Defendant on March 8, 2013, conducted the search and seizure of the Plaintiff's home and office on March 8, 2013, and then notified the Defendant of the commencement of a criminal investigation by a public official on March 27, 2013 (Bribery of the Act on the Aggravated Punishment, etc. of Specific Crimes) and on April 10, 2013 (Violation of the Act on the Registration of Real Estate under Actual Titleholder's Name). On April 11, 2013, the Plaintiff violated the Aggravated Punishment, etc. of Specific Crimes (Bribery of the Act on the Registration of Real Estate under Actual Titleholder's Name).

(1) Violation of the Act on the Registration of Real Estate under Actual Titleholder's Name (hereinafter referred to as "Violation of the Act").

(2) On November 27, 2013, the Plaintiff was sentenced to a suspended sentence of two years for one year of imprisonment for the crime of acceptance of bribe (preliminary facts charged) and the crime of violation of the Fraudulent Act in the Pyeongtaek District Court’s Eunpyeong Housing Site. (3) The Plaintiff was sentenced to a suspended sentence of two years (2013Gohap47) and thereafter on April 11, 2014.
