The prosecution of this case is dismissed.

Reasons

1. On April 23, 2017, the Defendant: (a) assaulted the victim’s body with his/her hand while doing a dispute with the Defendant’s wife C (n, 43 years of age) around 22:30 on April 23, 2017; and (b) assaulted the victim’s body with his/her hand.

2. Article 260 (1) of the Criminal Act which applies to the facts charged in the judgment: A judgment dismissing a victim's non-guilty declaration of intention to punish him/her after the prosecution under Article 260 (3) of the Criminal Act (Article 327 (6) of the Criminal Procedure Act)
