On October 29, 2012, Nonparty Company remitted KRW 500,000 to the Plaintiff’s account.

2. The plaintiff's assertion that both parties claim: the plaintiff lent money to the defendant and C.

Of the 500,000 won that the Plaintiff received in October 29, 2012, 200,000 won was appropriated for interest (25% per annum) and the remainder of 300,000 won was appropriated for principal and remains in 10,300,000 won.

Accordingly, the plaintiff seek the payment of the remaining principal and interest or damages for delay against the defendant.

The plaintiff extended money to the non-party company.

3. Determination

A. The part concerning C (the plaintiff was co-defendant of the first instance court, and the plaintiff withdrawn the lawsuit against C in the first instance court) to the defendant is not hard enough.

As to whether or not to lend KRW 10.6 million, each description of Gap evidence Nos. 5 through 7 is insufficient to recognize it, and it is otherwise recognized.
