1. The Defendant’s KRW 43,711,00 for the Plaintiff and 6% per annum from January 31, 2016 to April 8, 2019.
Reasons
1. The description of the grounds for the claim shall be as specified in the attached Form;
2. Judgment without holding any pleadings (Article 208 (3) 1 of the Civil Procedure Act);
3. The provision on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases concerning Expedition, etc. of Legal Proceedings (amended by Presidential Decree No. 29768, May 21, 2019) was effective from June 1, 2019. The portion of damages for delay exceeding 12% per annum out of the claims for damages for delay after June 1, 2019 is rejected.
