건축불허가처분취소
1. All appeals filed by the plaintiffs are dismissed.
2. The costs of appeal are assessed against the Plaintiffs.
The purport of the claim and appeal is the purport of the appeal.
1. Details of the disposition;
A. On January 10, 2018, Plaintiff A completed the registration of transfer of ownership on each land of D, G, H, D, EZ, EA, F, and E arising from the sale on November 13, 2017. Plaintiff C is an external village of Plaintiff A, and Plaintiff B is a person who completed the registration of transfer of cargo transport business under the trade name “EB” on July 1, 2016.
B. On April 25, 2017, the Plaintiffs filed an application with the Defendant for a building permit with a separate stable on each of the above lands purchased by the Plaintiff A. ① The Plaintiff newly built four animal and plant-related facilities (one main building, three accessory buildings) with a total floor area of 3,183 square meters in size in 3,183 square meters in total among the Plaintiff’s land D and E, and the Plaintiff newly built five animal and plant-related facilities (one main building, one building, and three auxiliary buildings) with a total floor area of 3,98 square meters in total (two main buildings, one building, and three auxiliary buildings) among F and E, and ③ the Plaintiff C newly built animal and plant-related facilities with a total floor area of 2,98 square meters in total (2,98 square meters in total, two buildings, and three auxiliary buildings) with a total floor area of 3,99 square meters in total.
(2) In addition to the application for each of the above building permits, each of the above new construction sites is "each of the above applications in this case" and the above new construction site is "each of the above new construction sites". ① In the vicinity of the application site, the ground for non-permission lies in an area where livestock pens and agricultural crops are concentrated with facilities for cattle sheds and agricultural crops (e.g., cattle sheds), and large mountain mountain penss are likely to be damaged due to the characteristics of raising mehs in the characteristics of raising large mountain penss in the vicinity of the site where the application site is filed, due to the obstruction of dust, chiller, and dust, e.g., tidal wave and agricultural crops generated from the valley, and sunshine, etc. < Amended by Presidential Decree No. 20690, Apr. 13, 2017; Presidential Decree No. 20680, Apr. 13, 2017>
