1. Defendant F shall be KRW 15,547,920 for the Plaintiff; Defendant I shall be KRW 17,326,280 for the Plaintiff; Defendant J shall be KRW 16,727,416 for the Plaintiff and the Defendant.
1. Determination as to the Plaintiff’s claim against Defendant F, I, and J
(a)the indication of claims: as shown in the corresponding part of Annex 1 against Defendant F, I, and J;
(b) Grounds for recognition: Judgment on deemed confession (Article 208 (3) 3 of the Civil Procedure Act);
2. Determination as to the Plaintiff’s claim against Defendant B, C, D, E, G, and H (hereinafter “Defendant B, etc.”)
A. Basic facts 1) The Plaintiff is a corporation operating taxi transport business, and six employees, including Defendant B, etc. concluded an employment contract with the Plaintiff and worked as a taxi driver belonging to the Plaintiff. 2) On July 1, 2015, the Plaintiff entered into an agreement with the Plaintiff on July 1, 2015 (hereinafter “instant wage agreement”). The main contents are as follows.
Article 1 (Basic Policies) Members shall pay the full amount of transport revenues to the company and implement a monthly wage system corresponding to the amount of receipt.
Provided, That it shall not be forced that the amount of the deposit would be different.
Article 6 (Transport Revenues) (1) The minimum transport earnings per day shall be deposited in the A.M. (9,500 won), P.M. (9,500 won) and the primary system (120,500 won).
(2) Where the standard monthly transportation revenue falls short of the standard monthly transportation revenue, it shall be deducted from the benefits.
(3) The deductible amount of transport income for the hours during which a vehicle is unable to be operated due to a malfunction, etc. while on duty shall be 11,500 won per hour shift, and 13,500 won for the primary system.
(Omission) Article 7 (Duty of Good Faith)
1. A driver shall pay to the company the minimum daily transportation revenues in good faith;
(2) Paragraphs (6) through (6) are omitted.
7. Where a state of operation is inferior in the output and recording of a tachograph, or there is any unfaithful business act, the first warning shall be given, and if there is no prior opening, the disciplinary action may be taken by referring it to the Disciplinary Committee according to the rules of employment.
Article 8 (Labor System) The wage system of drivers shall be the regular salary (basic salary, salary, achievements, overtime allowance, night work allowance), special salary, dues, retirement allowance, and other welfare benefits.
