1. Indication of Claim: In the case of the Busan High Court Decision 2012Na79777 after the Defendant filed a claim against the Plaintiff for damages by 2007Gahap7658, but the claim was dismissed, the judgment was rendered that “the Plaintiff shall pay KRW 64,494,252 to the Defendant and the delay damages therefrom,” and the above judgment became final and conclusive upon dismissal of the appeal against the above judgment.
Since the plaintiff deposits the full amount of the above judgment, compulsory execution based on the above judgment shall be dismissed.
2. Judgment made by deeming confession (Article 208 (3) 2, and Article 150 (3) and (1) of the Civil Procedure Act).
