On September 30, 2013, the Defendant was sentenced to imprisonment for fraud, etc. at the Seoul Eastern District Court on September 30, 2013, and the said judgment became final and conclusive on April 15, 2015.

1. Fraud against the victim C;

A. The Defendant committed the crime of 2008, around August 28, 2008, at a multilateral bank near the station of the Dong-gu Seoul Special Metropolitan City, Gwangjin-gu, the Defendant gave the victim C a certificate of loan with the Defendant’s wife D, and only borrowed money and used and repaid the money.

However, on April 2006, the defendant was unable to repay 200 million won from the injured party at all, and there was no intention or ability to repay the additional money even if he borrowed money from the injured party due to no particular property or income.

As such, the Defendant, by deceiving the victim, was given KRW 12 million as the borrowed money from the victim.

B. On October 25, 2010, the Defendant made a phone call to the victim C on October 25, 2010 and “an urgent need for money.”

It shall be paid up to lurt including up to the money borrowed before lending money.

However, the defendant was not 212 million won that he borrowed from the injured party, and there was no intention or ability to repay the money even if he borrowed additional money from the injured party due to no particular property or income.

As such, the Defendant, by deceiving the victim, was remitted 4 million won under the name of the Defendant from the damaged party, to the account in the name of the Defendant E.

2. On May 2012, the Defendant against the Victim F: (a) at the mutual infinite coffee shop located in Gangdong-gu Seoul Metropolitan Governmentro-dong, the Defendant: (b) provided the Victim F with the land located in Pyeongtaek-gun G after the appraisal of the land; and (c) provided the land to H as a security; and (d) received a certificate of KRW 3 billion in fake guarantee and issued the project fund.
