For the reasons indicated in its holding, the lower court determined that the instant facts charged were recognized, and rejected the grounds of appeal on the mistake of facts that asserted them.

The allegation in the grounds of appeal is factually disputing the fact-finding of the court below, and it is merely erroneous in the judgment of the court below as to the selection and probative value of evidence belonging to the free judgment of the court of fact-finding. In light of the evidence duly admitted, the court below did not err by exceeding the bounds of the free evaluation

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
