In light of the relevant legal principles and records, the lower court did not err by misapprehending the respective legal principles as to the act of posting a banner, which is prohibited under Article 90(1)1 of the Public Official Election Act, as alleged in the grounds of appeal, and the act of political party which does not violate the social rules, as alleged in the grounds of appeal by the lower court that found the Defendant guilty of facts constituting an offense in the first instance judgment.

Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
