1. The Defendant’s KRW 17,528,796,053 to the Plaintiffs and 6% per annum from April 28, 2018 to May 1, 2019.
Under the underlying facts, the following facts do not conflict between the parties, or may be acknowledged by comprehensively taking into account the overall purport of the pleadings in each description of Gap evidence Nos. 2-6, 25-27, Eul evidence Nos. 2, 11, and 15 (including a serial number unless the serial number is specified; hereinafter the same shall apply).
On May 26, 2010, the Defendant, including the conclusion of the instant contract, provided a bid guidance to select a new construction project to perform the construction of the block main complex facilities in Yeonsu-gu Incheon Metropolitan City (classified into multi-family housing, officetels, and sales facilities; hereinafter referred to as the “instant main complex facilities”), and the main contents thereof are as follows.
5. Terms of contract;
(a) Terms and conditions: Sales contract (payment on a three-month basis);
(b) Scope of contract: Design (including authorization and permission), construction, sale in lots (including approval for sale in lots) and occupancy business;
6. Method of selecting priority bidders;
(a) Assessment items: Proposal for maximum profits; and
(b) The details of the proposal for the construction project and the details of the proposal submitted for the items to be submitted. (1) The construction cost of the construction cost.
5. It shall be prepared and submitted in accordance with the Proposal Profit Calculation Schedule and separately sealed and sealed (Form 5).
