1. Of the parts concerning the counterclaim against the judgment of the court of first instance, those concerning the following order to perform:

Reasons

1. Under the basic facts, each of the following facts is not disputed between the parties, or can be acknowledged in full view of Gap evidence 1, evidence 2-1 to 12, evidence 4-1 to 3, evidence 7, evidence 12-2, evidence 14-1, evidence 14-2, evidence 18-1, evidence 15, evidence 19-3, evidence 6-1 through 6, evidence 8-1 to 11, evidence 5-1 to 5-12, evidence 5-1 to 5-12, evidence 1-2, evidence 14-2, evidence 14-2, evidence 18-1, and evidence 19-3, evidence 6-1 through 11, evidence 5-1 to 5-12, evidence Z of the first instance trial, and the whole purport of the arguments at the site of this court.

On November 18, 2002, the Defendant jointly purchased shares of 1,322.5/4,419 out of 4,420 square meters owned by Nonparty L on the same day, and completed the registration of transfer of ownership on the same day. Of the above land, the share of 1,774 (4,419-2,645)/4,419, which is L equity, was divided into M 1,774 square meters on the ground of a partition of co-owned property on January 22, 2003, and the Defendant and K shared 2,645 square meters (hereinafter “instant land”).

나. 원고 E는 이 사건 토지에 인접한, 그 소유의 분할 전 N 전 5,903㎡에 전원주택단지를 조성하면서 1994년경 이 사건 토지와 접하여 심한 경사지를 이루고 있던 분할 후 W, U 토지상의 별지 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉤의 각 점을 순차로 연결한 선내 지점에 두께 30cm , 길이 약 70m, 지하 1.5m, 지상 4m 높이의 철근콘크리트 옹벽(이하 ‘이 사건 옹벽’이라고 한다)을 설치하여 위 전원주택단지의 담장으로 제공하였고, 분할 후 W 토지는 콘크리트 포장을 하여 전원주택단지 내 사도로 제공하였다.

C. The rest of the plaintiffs except the plaintiff Eul, from October 2002 to December 2, 2002, designated and purchased a specific portion of the N's land before the said subdivision from the plaintiff E, and made a registration of ownership transfer for the above land for convenience, but the N's land before the said subdivision was made around October 2004.
