1. The Defendant shall pay to the Plaintiff KRW 70,754,389 as well as KRW 69,948,00 among the costs, from October 15, 2016 to the day of full payment.
The Plaintiff supplied CCTV camera, etc. to the Defendant from August 2010 to July 2015, and did not pay KRW 69,948,000 out of the price of the goods as of July 29, 2016; the Defendant paid the Plaintiff the price of the goods unpaid as of the end of each month to the Plaintiff and paid the amount in arrears by adding 22% interest per annum; the Defendant paid KRW 2,00,000 to the Plaintiff on August 31, 2016 and September 30, 2016, respectively, after serving the application for change of the purport of the instant claim and the cause of the claim. There is no dispute between the parties.
According to the facts found above, the Defendant: (a) 70,754,389 won (=the amount of unpaid goods 69,948,000 won) - The amount of overdue interest calculated at the rate of 22% per annum from June 23, 2016 to October 14, 2016, which is the closing date of the pleadings of this case, shall be appropriated first to the interest under Article 479(1) of the Civil Act (the amount of unpaid goods 69,948,00 won x 22% x 114/365 days, and less than won) - The amount of the Defendant’s repayment 4,00,000 won (the amount of interest under Article 479(1) of the Civil Act).
) Of them, the contractual overdue interest calculated at the rate of 22% per annum from October 15, 2016 to the date of full payment is obligated to pay 69,948,000 won.
Therefore, the plaintiff's claim of this case is justified within the scope of the above recognition, and the remaining claim is dismissed as it is without merit. It is so decided as per Disposition.
