Defendant shall be punished by a fine of KRW 6,000,000.
When the defendant does not pay the above fine, 100,000 won.
Punishment of the crime
On January 1, 2009, the defendant, B, and C entered into a partnership agreement with the purport that the defendant, B, and C shall jointly operate the E Jinsung-gun D with shares in the ratio of 4:3:0, and the defendant shall take charge of the fund management of the above company, but the defendant shall keep the company at the end of each month and distributed the shares at the rate of the above shares when he/she takes charge of the fund management of the above company.
On April 24, 2009, the Defendant arbitrarily consumed KRW 43,416,500 in total over 39 times in the same manner as follows, including: (a) while the Defendant kept the funds of the said company in the account of community credit cooperatives (Account Number:F) in the name of the Defendant; and (b) transferred 500,000 won to the Agricultural Cooperative account (Account Number G) in the name of the Defendant; and (c) paid the credit card payment by the same method until March 8, 2011.
