1. Basic facts
A. On December 11, 2012, the Defendant entered into an entrustment management contract with a land-unit housing company (hereinafter “land-unit housing company”) under which the Defendant entrusts the management of the instant apartment to the land-unit housing company (hereinafter “land-unit housing management contract of this case”) as a council of occupants’ representatives comprised of the residents in Ulsan-gu B apartment (hereinafter “instant apartment”).
B. The main contents of the instant management contract are as follows.
Article 9 (Vicarious Imposition and Collection of Management Expenses)
1. Management expenses, user fees and long-term repair appropriations (hereinafter referred to as "management expenses, etc.") shall be imposed, collected and disbursed by the head of the management office;
2. Management expenses, etc. to be paid shall be formulated annually by the head of the management office of the branch housing in consideration of the consumer price inflation rate and the rate of increase in wages for urban workers and approved by the defendant.
Article 11 (Payment of Commission Fees and Management Service Fees)
1. The defendant shall pay the fees for entrusted management to the Dosan Housing from the date of the contract to the end of each month until the termination of this contract.
Monthly fees: 219,681 square meters x 6.62 won per square meter = 1,460,870 won (including value-added tax)
2. The defendant shall pay the above entrusted management fees or the expenses for entrusted management services approved by the defendant to the local housing unit by the end of each month.
Article 14 (Payment of Retirement Allowances)
1. The defendant shall impose and collect retirement allowances from the management expenses for the unpaid retirement allowances to the employees of the management office, and shall require them to continue to accumulate the unpaid retirement allowances, and shall require them to pay the retirement allowances to the employees concerned when the reason for the retirement of
