1. The Defendants are jointly and severally liable to the Plaintiff 106,786,317 won and the interest rate of 15% per annum from August 9, 2016 to the date of full payment.
The following facts are acknowledged in full view of each statement in Gap evidence Nos. 1 through 11 and the purport of the whole pleadings.
① A around February 2009, the Plaintiff entered into a drug transaction agreement with Defendant A, and supplied medicines to Defendant A from that time, and Defendant B and C jointly guaranteed the obligation to pay goods to Defendant A.
② The amount of goods unpaid as of the date of closing argument of the instant case is KRW 106,786,317.
Therefore, the Defendants are jointly and severally liable to pay to the Plaintiff KRW 106,786,317 as well as damages for delay calculated at the rate of 15% per annum from August 9, 2016 to the date of full payment, which is the day after the date of final delivery of a copy of the complaint.
The plaintiff's claim is justified and accepted.
