Defendant shall be punished by imprisonment for a term of one year and six months.

However, the above sentence shall be executed for a period of three years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

No one shall distribute or use, or display or keep for such purposes, game products different from the classification of a rating, and shall exchange, exchange, arrange for exchange, or repurchase such tangible and intangible results obtained through the use of game products as a business.

On December 2, 2017, the Defendant heard the speech from the Gu to the effect that “the head of the game may produce profits if operating the head of the game, and may recover investments within the two-year month,” and opened the game room. On December 8, 2017, the Defendant purchased 40 million won per unit of “the sea c and 1,6 million won per unit of “the Internet c and 1st class of new credit” game from his/her name and purchased 40 million won per unit of 16,000 won, and around February 11, 2018, the Defendant leased the deposit of KRW 5 million per month and KRW 1 million per month, and around that time, invested approximately KRW 3,00,000,000,000 for the total of KRW 8 million for installation and purchase of goods, etc., and operated the game hall “D” at the place.

The Defendant operated the game hall from February 22, 2018 to April 5, 2018, the Defendant: (a) opened the game room in order to maximize the profit from the operation of the game room; (b) opened three instances of red pressings of the game machine in order to make the equipment paid points by manipulating a conference; and (c) installed the USB file purchased from a nameless game business operator to make the equipment accumulated instead of water, so that the points of which are installed with the game material that has been modified differently from the rating classified by the Committee on Water Management may be accumulated further; and (d) offered or displayed for use by unspecified customers; and (e) displayed for this purpose the points that the said customer acquired through the use of the game product as a result of receiving cash from other customers or mediating them to exchange them into money on a total amount of KRW 7120,00.20 won.
