1. The defendant is 43,316,096 won to the plaintiff and 5% per annum from March 1, 2005 to September 28, 2006.
Reasons
1. Indication of claims: It shall be as shown in attached Form; and
2. Judgment by public notice: Article 208 (3) 3 of the Civil Procedure Act.
3. Since the amended provision on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases concerning Expedition, etc. of Legal Proceedings (Presidential Decree No. 26553) was promulgated on September 25, 2015 and enforced on October 1, 2015, the Plaintiff’s claim for damages for delay was partially dismissed.
