1. Defendant A

A. The Defendant, as a staff member of the maritime transport chain B, is the person responsible for the management of the E (31 ton) towing vessel.

The owner of a ship shall, in consideration of the navigation area, size, use, output of a propelling engine, and other matters concerning the safety of ship navigation, have an engineer meeting the standards for service aboard ship's personnel prescribed by Presidential Decree work on board, and a tugboat of less than 200 tons sailing the sea area in accordance with such standards shall have the captain, the first class mate, and the chief engineer work on board the ship as an employee on deck.

Nevertheless, the Defendant, at around 16:10 on March 28, 2017, sailed from the Gangwon-do Naval Base, which was around 13:30 on April 2, 2017, without having 1st mate work on the ship, a tugboat of B, which is a 31 ton of B, and had him sail on the sea near Busan Southern-type system.

B. As above, the Defendant was investigated into violation of the law of ship personnel at the Incheon Coast Guard by failing to have the 1st class mate aboard the ship, and the 1st class navigationr immediately left the 1st class navigational police station immediately before the occurrence of the 1st class navigational crime, leaving the 1st class navigational ship E immediately before the occurrence of the 1st classal navigational crime, making the list of ship crew members inevitably caused the violation of the law, and submitted it to the investigation

1) From January 11, 2017 to March 28, 2017, the Defendant, at around 18:00, copied the official seal of the crew in the name of the Incheon Regional Maritime Affairs and Fisheries Office, which was affixed at the time of reporting the crew's getting on and leaving a ship using a local composite machine, at the office of the company B located in the Nam-gu Incheon Metropolitan City F building 806, and entered the official seal on the crew list in the crew list, and then, the 1st degree navigational G was on board the said E from January 11, 2017 to March 28, 2017.
