피고인들은 2018. 9. 9. 00:10경 당진시 C에 있는 ‘D’ 음식점에서 피고인 B은 피해자 E(32세)와 이야기를 하던 중 욕설을 하면서 갑자기 피해자의 목덜미를 잡아 밀치면서 피해자의 목 부분을 수회 밀치고, 피고인 A은 피해자가 피고인 B에게 언짢은 말을 했다는 이유로 오른손으로 의자를 집어 든 상태로 왼손으로 피해자의 머리채를 잡고, 계속하여 피고인 B은 왼손으로 피해자의 뺨을 1회 때리고, 피고인 A은 가게 밖으로 도망치는 피해자를 따라 가 손으로 피해자의 머리를 잡아 무릎으로 피해자의 머리를 찍고, 계속하여 주먹으로 피해자의 얼굴을 20회 정도 때려 피해자에게 약 2주간의 치료가 필요한 열린 두개내 상처가 없는 진탕 등의 상해를 가하였다.
