[Basic Facts] The Defendant made a false statement to the victims to the effect that “an investment may be made in connection with the auction of real estate or the operation of an entertainment store,” and intended to receive money from the victims as the borrowed money.

[Criminal facts]

1. On August 8, 2012, the victim C calls the victim at a non-permanent place (hereinafter referred to as “non-permanent place”) and lends money to this person after receiving documents as a security for monthly rent or rent deposit. The proceeds therefrom are generated.

I made a false statement to the effect that, “I will make a repayment with the interest and interest in return for a high profit from lending money to I.B.”

However, the defendant did not have a certain amount of income at the time, and did not have any work related to real estate, and there was no intention or ability to repay money even if he borrowed money from the damaged person because he thought to be used for personal purposes by receiving money from the injured person.

As above, the Defendant: (a) deceiving the victim; (b) received money from the victim to the account (D) in the name of the Defendant on the same day from the victim; and (c) deceiving the victim by the same method over 43 times from around that time to August 5, 2014; and (b) received money from the victim totaling KRW 258,930,00 from the victim.

2. On April 10, 2013, the Defendant called “the victim E by phone to the victim at a non-permanent place with a view to making it possible to make profits high from lending money to the head of an entertainment business establishment and the head of a family with the inside of the bar, and to guarantee the principal when it is set up a security on the security deposit of the studio rent in which the Gaz resides.” The Defendant made a false statement to the effect that “if Gaz lends money to the victim, she will make a repayment again to the higher interest by making an investment in that place.”
