Defendant shall be punished by a fine of eight million won.
If the defendant does not pay the above fine, KRW 100,000.
Punishment of the crime
1. Violation of the Customs Act;
(a) Where it is intended to export other goods whose declaration is sealed, the name, standard, quantity, price, etc. of the relevant goods shall be reported to the head of a customs office, and no goods which are different from the relevant goods shall be exported;
Nevertheless, the Defendant, in collusion with the representative G of F, an export agency in Seongbuk-gu Seoul, exported 30 Wons on January 8, 2013 (export price of KRW 940,800) to H, a Japanese customer through F, through the above F. The Defendant reported and exported the export declaration number I to the head of the customs office in T-SHITRTS (No. 6109-1000) and LADES PSS (No. 6204.62-9000).
In addition, the Defendant exported 3,491 points (export price of 44,894,682) such as primary fee, bank, mother and child, etc. from January 8, 2013 to June 23, 2013, in collusion with G, the Defendant reported and exported them to the head of the customs office TR-HITRTS and LADIES PTS, each of which is different goods.
(b) Where any person who intends to export goods whose name, standard, quantity and price, and other business registration number, overseas buyer code, etc. prescribed by Presidential Decree are declared by the head of any customhouse, he/she shall not file a false declaration with the head of any customhouse;
Nevertheless, the Defendant, in collusion with the above G on January 8, 2013, exported line 20 points (export price of KRW 441,00) via the above F to H, and filed with the customs collector a false declaration of export declaration number I, price, exporter’s business registration number, and overseas trading place.
In addition, the Defendant, in collusion with G, exported 5,299 points (export price of 86,69,025) such as T-SITRTS, PNTS, etc. from January 8, 2013 to July 7, 2013, and filed a false report with the head of the customs office on the volume, price, the exporter's business registration number, and the overseas trading place.
