The defendant shall pay 54,285,836 won to the plaintiff and 12% per annum from December 27, 2019 to the day of complete payment.
1. On June 7, 2019, the Plaintiff: (a) supplied materials, such as cable tracks, to the Defendant’s construction site (on the site of complete week C, D Complex) from June 10, 2019 to April 10, 202; and (b) concluded a supply contract with the content that the price shall be paid on the 20th day of the following month after the settlement of accounts on every 20th day; (c) the Plaintiff supplied materials, such as cable tracks, to the Defendant’s construction site from June 10, 2019 to September 30, 2019; (d) the Plaintiff did not receive KRW 54,285,836 from the price to the Defendant’s construction site; or (e) did not have any special dispute between the parties; or (e) did not fully recognize the purport of the entire pleadings and arguments as a whole.
Therefore, the Defendant is obligated to pay to the Plaintiff the amount of KRW 54,285,836, and to pay damages for delay calculated at the rate of 12% per annum from December 27, 2019 to the date of full payment, which is the day following the delivery date of the original copy of the instant payment order.
2. In conclusion, the plaintiff's claim of this case is reasonable, and it is so decided as per Disposition.
