1. The Defendant shall pay to the Plaintiff KRW 39,074,450 and the interest rate of KRW 15% per annum from December 18, 2016 to the date of full payment.
1. Indication of claim;
A. On December 10, 2012, the Plaintiff entered into a lease agreement with the Defendant on a deposit amounting to KRW 18 million and KRW 1.8 million per month of rent with respect to the five-story factory building located in Bupyeong-gu, Jungcheon-gu, Seoul, and the five-story factory building. The Plaintiff leased the above building to the Defendant.
B. As the above lease contract was terminated due to the Defendant’s delinquency in rent, the Defendant delivered the above building to the Plaintiff, and the Plaintiff paid KRW 72,759,000 on behalf of the Plaintiff the aggregate of all expenses, such as personnel expenses, ridge rent, transportation expenses, waste disposal expenses, etc. incurred while transferring the building.
C. Since part of the Plaintiff’s above claim is paid in kind by the Defendant with D’s name, and part of the claim remaining as of the date of satisfaction with the lease deposit is KRW 39,074,450, the Plaintiff sought payment of the above money against the Defendant.
