1.The judgment of the first instance, including a claim extended and reduced in the trial, shall be modified as follows:

Reasons

1. Basic facts

A. On August 10, 1945, G 294 square meters prior to G (hereinafter “instant land before the instant subdivision”) was divided into 160 square meters prior to G and 134 square meters prior to G. The said G was divided into 160 square meters prior to G and 134 square meters prior to G. The said 160 square meters prior to G was divided into 436 square meters prior to G (22 square meters prior to G registration conversion: 28 square meters prior to G registration conversion) and 93 square meters prior to J road (28 square meters prior to G registration conversion) on April 30, 1971. The said 436 square meters prior to G was divided into 280 square meters prior to G and 156 square meters prior to K on November 21, 1978.

원고의 배우자인 L(1983년경 사망)은 1946. 11. 26. H으로부터 이 사건 분할 전 토지를 매수하여 점유ㆍ사용하기 시작하였고, 원고와 L은 1965.경 I 토지 지상에 주거용 건물(이하 ‘이 사건 주택’이라 한다)을 건축하였으며, 1972.경 이 사건 주택의 부속건물(이하 ‘이 사건 부속건물’이라 한다)을 건축하였는데 위 부속건물 중 일부가 이 사건 토지 중 별지 도면 표시 ㄱ, ㄱ¹, ㄴ¹, ㄷ¹, ㄹ¹, ㅁ¹, ㅂ¹, ㅅ¹, ㅇ¹, ㅁ, ㅂ, ㅅ, ㄱ의 각 점을 순차로 연결한 선내 (나) 부분 34㎡{이하 ‘이 사건 (나) 부분’이라 한다} 지상에 위치하게 되었다.

또한 1965.경부터 이 사건 토지 중 별지 도면 표시 ㄱ¹, ㄴ, ㅊ¹, ㅈ¹, ㄴ¹, ㄱ¹의 각 점을 순차로 연결한 선내 (다) 부분 12㎡{이하 ‘이 사건 (다) 부분’이라 한다}가 이 사건 주택과 공로를 연결하는 통행로로 사용되었다.

C. As to the instant land, the registration of ownership transfer was completed on October 5, 1973 in the name of N (Death on November 23, 2013) on March 14, 1979.

With respect to I's land and K's land, the registration of transfer of L's ownership was completed on the ground of sale as of January 30, 1980 from November 26, 194, and the name of the plaintiff on March 19, 1994, the name of the plaintiff on March 10, 2010, and the name of the plaintiff on October 7, 2013, respectively.
