1. Basic facts
A. The Plaintiff is the owner of D large 159 square meters (hereinafter “1 real estate in this case”) and C large 109 square meters (hereinafter “2 real estate in this case”).
B. From June 20, 201, the Defendant owned the building of the assembly-type panel (hereinafter “the instant building”) located over the E-type 99 square meters adjacent to the instant real estate (hereinafter “third real estate”) and the building of the assembly-type panel (hereinafter “the instant building”) located over the third real estate of this case and the part “B” of the first real estate of this case, which is located over five square meters in a ship (hereinafter “influent part”).
C. The Defendant removed the instant building constructed in the area that was invaded by the result of the survey conducted by the Korea Land Information Corporation among the instant litigation drawings.
The sum of rent from June 20, 201 to July 24, 2015 on the invaded part is KRW 288,500.

2. Determination as to the legitimacy of a boundary confirmation claim among the principal lawsuit
가. 원고의 주장 피고는 이 사건 건물을 설치함으로써 경계 선상에 있는 원고 소유의 이 사건 제1부동산을 침범하였으므로, 원고 소유의 이 사건 제1, 2 부동산과 피고 소유의 이 사건 제3부동산의 경계는 지적공부상의 경계인 별지 도면 표시 ㅍ, ㅌ, ㅈ, ㅇ, ㅎ의 각 점을 차례로 연결한 경계선이 되어야 한다고 주장한다.
B.
