1. The Defendant’s KRW 140,000,000 and its amount shall be 15% per annum from March 21, 2019 to May 31, 2019 to the Plaintiff.
According to the purport of Gap evidence No. 1 and all pleadings, the plaintiff is deemed to have lent KRW 140 million to the defendant on June 28, 2018. Thus, the defendant is obligated to pay to the plaintiff delay damages calculated at the rate of 15% per annum from March 21, 2019 to May 31, 2019, which is the day following the delivery date of the original copy of the payment order in this case, and from the next day to the day of full payment.
Therefore, the plaintiff's claim of this case is justified within the scope of the above recognition, and the remaining claim is dismissed as it is without merit. It is so decided as per Disposition.
