1. Examining the reasoning of the lower judgment as to the Defendant’s grounds of appeal in light of the evidence duly admitted by the lower court, the lower court is justifiable to have determined that all of the facts charged in the instant case (excluding the portion of innocence) is guilty

The court below did not err by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by misapprehending the relevant legal principles.

2. Examining the reasoning of the lower judgment on the grounds of appeal by the prosecutor in light of the records, it is justifiable to reverse the first instance judgment convicting the Defendant on the ground that there is no proof of a crime of violation of the Act on Registration of Credit Business, etc. and Protection of Finance Users among the facts charged in the instant case, and to find the Defendant not guilty, contrary to the allegations in the grounds of appeal

3. Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
