1. The Plaintiff:

A. Defendant B Housing Redevelopment Project Association, C, D, E, F, G, H, J, K, L, M, M, N,O, P, Q, Q, W, X, Y, and Z.

Reasons

Basic Facts

The plaintiff is a company that runs the construction business.

B The Promotion Committee for the Establishment of the Consolidation Project (hereinafter referred to as the "Promotion Committee of this case") was established on February 25, 2004 with the approval of the competent authority on February 25, 2004 in order to implement a housing redevelopment project on approximately approximately 65,610 square meters in Seoul Special Metropolitan City AB.

Defendant B’s Housing Redevelopment Project Association (hereinafter “Defendant Association”) obtained authorization for establishment from the original mayor on May 7, 2007, and comprehensively succeeded to all rights and obligations of the instant promotion committee under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents, which completed the establishment registration on May 15, 2007.

A and Defendant C, D, E, F, G, H, I, J, K, L, M, M, N, P, Q, V, W, X,Y, and Z (hereinafter collectively referred to as “A and the rest of the Defendants”) are directors, auditors, and delegates of the Defendant Union.

On December 17, 2015, AA died on December 17, 2015, and accordingly, the defendant R, his wife, and the defendant S, T and U respectively inherited the property of AA.

The statutory inheritance of the property successors of AA is 3/9 of the defendant R, the defendant S, T, and U. 2/9 respectively.

On May 10, 2016, the Defendants filed a report on the inheritance limited recognition with the Chuncheon District Court Branch Branching 2016-Madan213, and was tried on May 13, 2016 by the said court to accept the said report.

Article 14 [project promotion cost] ① The project promotion cost under the contract of the Plaintiff and the instant promotion committee is as follows, and Eul (referring to the Plaintiff; hereinafter the same shall apply) directly lends the project promotion cost to Gap (referring to the instant promotion committee; hereinafter the same shall apply) or lend it through loans from the financial institutions designated by Eul (hereinafter the same shall apply) in accordance with separate terms and conditions of lending.
