The appeal is dismissed.
The costs of appeal are assessed against the defendant.
Reasons
Since this case is a small amount case to which the Trial of Small Claims Act applies, an appeal may be filed with the Supreme Court only if there is a reason prescribed in Article 3 of the same Act.
However, the ground of appeal alleged by the defendant does not fall under any of its cases, and thus cannot be a legitimate ground of appeal.
Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
