The prosecution of this case is dismissed.
1. On May 17, 2015, the Defendant, at around 09:00 on May 17, 2015, 2015, she heard the horses from the victim C (at the age of 27 years) who was sexually female friendly in front of the Incheon Bupyeong-gu, Incheon, about 27 years of age, she pushed the victim into the wall by putting the breath, and sping about 2:3 times on the victim’s face, and assaulted the victim’s face at one time on the left side of the victim’s face.
2. The facts charged in the instant case are crimes falling under Article 260(1) of the Criminal Act, and cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act. According to the written withdrawal of the complaint, the victim C has withdrawn his/her wish to punish the Defendant on September 14, 2015, which is the date the instant indictment was instituted. Thus, the instant indictment is dismissed pursuant to Article 327(6) of the Criminal Procedure Act.
