그럼에도 불구하고 피고인은 2020. 5. 14. 경부터 2020. 6. 10. 경까지 위 1 항 기재 성매매업소를 광고하기 위하여 성명 불상의 광고 대행사 직원을 통해 성매매 알선 포털사이트인 ‘E’, ‘F’ 등에 ‘G’ 라는 제목으로 ‘ 전립 선 맛사지, 섹슈얼 마사지’, ‘24 시, 100% HD 실사, 주간 11만, 투 샷 15만, 동 반할인, 심야 천사, 강북 1등 사이즈, 20대 여대생 입 싸 서비스, 호텔 식 마사지 힙 업 & 전립선, 재방문율 1위, 라면, 짜 파 정식 무료제공' 등 문구와 업소 상호명, 영업시간, 업소 위치 등을 게시하였다.
