1. Facts of recognition;
A. The Plaintiff is a company aimed at selling, maintaining, and repairing office equipment and information and communications equipment, and the Defendant is a person who operates, copying, and printing the uniforms within the E University located in Suwon-gu, Suwon-si, as the trade name “C”.
B. Around September 11, 2009, the Plaintiff entered into a contract with the Defendant for the operation of unmanned reproduction machines and printers, the main contents of which are to install the Plaintiff’s unmanned reproduction machines and printers in the E-university reproduction room operated by the Defendant and to pay a certain percentage of the sales to the Defendant.
After the conclusion of the above contract, the Plaintiff and the Defendant concluded a second contract on September 1, 2014 and February 2, 2016 (hereinafter “the first contract of September 11, 2009”; the term “the second contract of September 1, 2014”; the term “the third contract of this case”; the term “the third contract of this case”; and the terms of the third contract of this case finally made between the Plaintiff and the Defendant are as follows.
Pursuant to the following contract between the Plaintiff (hereinafter referred to as “A”) and the Defendant (C: E.E., hereinafter referred to as “B”), the Plaintiff and the Defendant (hereinafter referred to as “B”) shall enter into a contract for the operation of the U.S. and the printer:
§ 1(Definitions) The term “A” means installing a unmanned copy and printer in the place of business “(E ramper)” and providing all services for the normal operation of the machinery, and paying to “A certain portion of the sales revenue arising therefrom”.
