1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
1. Details of the disposition;
A. The Plaintiff is a corporation established for the purpose of elevator installation work business.
B. On June 7, 2018, the Incheon Regional Government Procurement Service announced a public announcement of tender (demanding Agency: C’s institution, estimated price: KRW 259,802,727; hereinafter “instant public announcement of tender”) with respect to the installation of escalators (hereinafter “instant escalator”) among new construction works, and the first highest price was selected as bidders.
The parts related to this case in the specifications attached to the above tender announcement (hereinafter referred to as “the specifications of this case”) shall be as follows:
1-2. Submission of reports on commencement of construction works;
(b)The report on the commencement of construction shall include the following:
(C) Quality control plan (2) Application 1-2-4 of the previous Act (Abolition of January 28, 2017) Article 15 of the Electric Appliances Safety Control Act (Certification of Electrical Appliances, etc. subject to Safety Certification or Standards for Kmark Certification conducted by the Korea Industrial Technology Laboratory)
(g) Reporting, authorization, and permission application documents 2) The counter-party to the contract shall submit documents proving safety certification and completion certificates prior to the completion inspection, conducted by the Kmark Certification and the Korea Testing Laboratory under Article 13 of the former Act ( repealed by January 28, 2017) or Article 15 of the Electric Appliances Safety Control Act (Safety Certification of Electrical Appliances, etc. subject to Safety Certification) or the Korea Testing Laboratory.
