A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The victim B was a person who was evaluated as 13 years of social age (SA) and 81.25 years of social index in the examination of the level of social well-being of a mental health department conducted at the age of 35, and the Defendant was a victim B and a middle school building. The Defendant used the above situation of the victim in order to resolve its economic difficulties by receiving a loan in the name of the victim.
1. Forgery of private documents and the display of private documents;
A. On December 28, 2016, the Defendant forged private documents: (a) on the paper of “M Moble Agreement” in the C Office located in Chungcheongnam-gun, Chungcheongnam-gun, the Defendant entered “D”, “24”, and “800” in the column of charge, using a tamper, and entered B’s name in the column of contract duration; (b) the applicant/subscriber’s private person; and (c) entered B’s personal information, address, telephone number, etc. in the customer information column using a tamper; (d) entered the automatic transfer item in the automatic payment column; (e) entered the name of the private person in B; (e) stated the application form in B; and (e) stated the application form in B; and (e) stated the application form in B; (e) stated “24” in the column of contract period; and (e) stated “30 months” and “10 months” in the column of communication fee in the column of column 5; and (e) stated “30 months” and “10 months” in the column of communication fee.
Accordingly, for the purpose of uttering, the Defendant forged three copies of private documents related to application for subscription to mobile phone in the name of B, a private document related to rights and duties.
B. The Defendant at the time and place indicated in the foregoing paragraph (a) is genuine with three copies of the document pertaining to the application for subscription to a forged mobile phone at the time and place specified in the above paragraph (3).
