1. The Defendants shall have jurisdiction over Chuncheon District Court with respect to each of the real estates listed in the separate sheet to the Plaintiff.
1. Determination on the cause of the claim
A. The Plaintiff’s assertion 1) The Plaintiff’s respective real estate listed in the separate sheet (hereinafter “instant real estate”).
(2) Around July 2015, the Plaintiff’s father D, around July 2015, entered into a lawsuit seeking return of unjust enrichment against Defendant B, and the Plaintiff entered into a provisional attachment on the instant real estate, and Defendant B made a registration of the right to claim transfer of ownership in the name of a third party and made the registration of the right to claim transfer of ownership in the name of the third party.
3) Around July 21, 2015, D gave the Plaintiff’s seal impression and certificate of personal seal impression to Defendant B. According to the Plaintiff’s real estate sales contract (Evidence A2) entry, Defendant B purchased the instant real estate in KRW 360,000,000, and the down payment shall be paid KRW 20,000 on July 20, 2015, and the intermediate payment shall be paid KRW 140,00,000 on July 21, 2015; the remainder shall be paid KRW 200,000,000 on October 30, 2015; and the remainder shall be paid KRW 200,000,000 on October 30, 2015. On the following day, the Plaintiff prepared the following:
1. All buildings of E land E in Gangwon-do and of the above ground Adong C-dong Factory Building on the ground.
2. All materials and all the equipment and tools installed inside the factory;
3. All the office fixtures of a second-story office;
4. All the equipment, tools, and fixtures shall not be taken out without consent of the transferee, after the contract is concluded.
5. Bank loans shall be deemed to have been succeeded to by the transferee and shall be deemed to have paid the balance immediately after such succession.
6. The transferee shall be liable to the transferor for obligations prior to the registration, and shall pay the intermediate payment and the balance after deducting the equivalent amount for all matters, including provisional seizure on the right of registration.
B and Defendant B affixed a separate seal on the above real estate sales contract and the separate attached matters.
